How to Start a Business in Spain as a Foreigner?
- 1
Choose Your Business Structure
The first step to start a business in Spain as a foreigner is to choose the business structure. As a foreign entrepreneur, you can consider incorporating a Sociedad Limitada company, a Subsidiary company, a representative office, or a ready-made company.
- 2
Apply for the NIE Number
Secondly, you must obtain your NIE (Foreigner Identification Number). You can apply for it through a Spanish consulate or appoint a legal representative to handle the process on your behalf.
Our experts are here to guide you through every step and ensure a smooth application.
- 3
Prepare the Company Documents
The third step for registering a business in Spain as a foreigner involves drafting the essential legal documents for incorporation, including company bylaws, name reservation certificate, and other documents.
- 4
Open a Spanish Business Bank Account
Next, you must set up a business bank account in Spain and deposit the share capital there. You must obtain a bank certificate confirming the deposit, which is required for notarization.
- 5
Notarize the Incorporation
Once your documents and share capital are ready, all founding members—or their legal representatives—must appear before a Spanish public notary. During this appointment, they are required to sign the incorporation deed.
This notarized document is a legal requirement to move forward with business registration.
- 6
Register with the Mercantile Registry
After notarization, the incorporation deed is submitted to the Registro Mercantil. Once approved, your company receives a CIF (corporate tax ID) and is legally recognized to operate in Spain.
